THE ADDITION OF MANDATORY IDENTIFICATION DATA TO THE BUSINESS REGISTER OF THE SLOVAK REPUBLIC WILL BE AUTOMATED

#23The addition of mandatory identification data to the Business register of the Slovak Republic will be automated

The Ministry of Justice of the Slovak Republic, in cooperation with the registry courts, will relieve entrepreneurs and perform an automated addition of identification data to the Business register on their behalf.

According to the amendment to the Commercial Register Act from 2019, persons registered in the Business Register are obliged to supplement the identification data on all persons appearing in the Business Register in a certain legal status, e. g. shareholders or procurist, by 30 September 2022 at the latest.

Using the data already available to the state, the Ministry of Justice of the Slovak Republic will perform the automated supplementation of identification data, no later than 31 May 2022.

However, this may not be possible for some of the registered persons, as the data kept may not be sufficient to identify them uniquely. If there is no automated addition of identification data, the registered persons will request the completion of this data, and if the proposal for registration of the change will only concern the completion of these data, these persons will also be exempt from the related fee.

Thanks to this addition, it will be possible to automatically download data on persons from other public administration information systems. Therefore, for example, if a shareholder moves or changes his or her name, the company will no longer have to file a paid application to change the entered data, but it will be possible to process the change of data in the Business register automatically by using the data about a person in the register of natural persons.

This rule should be fully reflected in the forthcoming new law on the Business register, which will be introduced to the public soon. The amendment to the Business register Act and the Court Fees Act is currently in the inter-ministerial comment procedure.
